US pop star Madonna has left Malawi on a private jet after failing to adopt a second child from the country.

Last week a Malawian court rejected the adoption over residency rules but the singer’s lawyer has said that she will appeal against the ruling.

The 50-year-old singer applied to adopt Chifundo James, whose name translates into English as Mercy, on Monday.

Chifundo is in the same orphanage that previously housed David Banda, Madonna’s first adopted child.

Had her application been successful, Chifundo would have been a sister to David and her biological children Lourdes and Rocco.

Madonna’s application was rejected because of a requirement that prospective parents be resident in the southern African state for 18 to 24 months.

No date has been set for a court hearing to appeal against the judge’s ruling.

Malawian rights group, who acused the goverment of skirting residency laws when Madonna adopted David Banda in 2006, also opposed the latest adoption attempt. They say celebrities should not be allowed to fly in and adopt children at will.

An AIDS epidemic in the impoverished southern African country has orphaned more than one million children and Madonna has set up a charity for Malawian children.

Above all the trouble she had in adoption Mercy, her ex husband, Guy Ritchie,  issued the following statement in response to the news:

“I fully supported Madonna in her decision to apply for this adoption, and I am saddened that her application has been rejected. She is motivated only by being a caring parent who seeks to share some of the advantages and opportunities that her life has given her.”

The director added, ”Madonna is a fantastic and loving mother who cares deeply about her own children, and children who may need additional help and support. This time it did not work out, but there will be other opportunities and I wish her well in them. She is a great mum.”

Madonna is having a sincere love for children in so many way. Hopefully she could thru all this problem smoothly, and people do not look the problem in politic way, but from love and caring way. Not only for Mercy but for all unlucky children in the world.

Madonna was said to be ‘devastated and shaking’ at having to leave Mercy James, four, behind in Malawi.

Sources said Madonna told him: ‘Do whatever you can to get me my Mercy; I can’t imagine her going back to the orphanage.’

The singer and her eldest daughter Lourdes, 12, were said to have fought back tears as they left Malawi without the child. Madonna also reportedly told aides: ‘I can’t believe I’m leaving my beautiful baby behind. It’s not right. I love that baby girl . . . She’s my little girl  –  she needs to be with me.’

Officials have already returned Mercy to an orphanage, despite the appearance of a man claiming to be her biological father.

Security guard James Kambewa, 24, said he was willing to take a DNA test to prove he was Mercy’s father and wants to raise the child.

If the court in Malawi accepts his paternity claim it is likely to be the final blow to Madonna’s hopes of adopting the child. Mr Kambewa, who lives in a remote village 100 miles from Lilongwe, said he was told Mercy had died with her mother the birth.
